Privacy Policy

This policy explains what information 538 Creative collects through 538creative.com, including the contact form and the Employee Communication Health Check, how it’s used, and who it’s shared with. It doesn’t apply to any other site or service.

538 Creative is a sole proprietorship operated by Martin Foley, MA. Questions about this policy or your information can be sent to martin@538creative.com.

The contact form collects whatever you choose to include, typically your name, email address, organization, and message. It’s used only to respond to you and isn’t added to a marketing list unless you separately opt in.

The Health Check itself doesn’t require any personal information to complete. You can answer all 20 questions and see your results without providing a name or email address. Your answers and calculated scores are stored only in your own browser (not on a server) so your progress survives an accidental refresh and your results page works if you revisit it on the same device.

If you choose to request a personalized PDF report, we collect your first name, email address, and organization (optional), plus whether you’d like occasional communication and engagement insights from 538 Creative. That consent checkbox is unchecked by default. We also record your assessment answers and calculated scores alongside that request, so we can generate your report and understand, in aggregate, how organizations are using the tool. We don’t ask for information that identifies any individual employee other than you, the person completing the assessment.

We rely on a small number of third-party services to run this site. Each processes information only as needed to provide its service to us, and none are permitted to sell your information:

• Formspree: processes contact form and Health Check report-request submissions and delivers them to us by email.
• Resend: sends the Health Check PDF report to the email address you provide, when you request one.
• Google Analytics: collects anonymized, aggregate usage data (pages visited, general location, device type) so we can understand how the site is used. It does not receive your Health Check answers or report-request information.
• Netlify: hosts this website.

We don’t sell or rent your information to third parties. We don’t use your Health Check answers to identify or evaluate any individual employee other than the person who completed the assessment. We don’t currently compare your organization’s results against other organizations. See the Health Check’s methodology note for more on that.

Your in-progress Health Check answers live in your browser’s session storage and clear automatically once you finish or close the tab. A completed result is cached in your browser’s local storage so a results link keeps working on that device; you can clear it anytime through your browser’s site data settings. Report requests and contact form submissions are retained in our Formspree account for as long as reasonably useful for follow-up, and can be deleted on request.

You can complete the Health Check anonymously and skip the report request entirely. If you’ve requested a report and want your information deleted, or want to opt out of future insights emails, contact martin@538creative.com and we’ll take care of it.

This site is intended for working professionals evaluating organizational communication and isn’t directed at children. We don’t knowingly collect information from anyone under 16.

If this policy changes, we’ll update the effective date above. Continued use of the site after a change means you accept the updated policy.
